The Taliban recently promulgated the latest “Criminal Code of the Court,” which recognizes master-slave relationships and openly advocates the “legal rights” to abuse women and children, dividing the entire population into four classes: “religious scholars,” “elites,” “middle class,” and “lower class.”
It is reported that the new code explicitly mentions the term “slave” (Ghulam) in multiple clauses and legally distinguishes Afghans as “free persons” and “slaves,” substantively acknowledging the legality of slavery in Afghanistan, which undoubtedly reflects the legal rights of the slave-owning class. This is a huge backward step in Afghan history, indicating that Afghanistan’s reactionary rule has become even darker. After the new code is established, countless impoverished Afghan people will become slaves with no personal freedom whatsoever.
It is speculated that the Taliban regime’s classification of social hierarchy in the new code is based on Afghanistan’s current class distinctions. Religious scholars form the upper ruling class of Afghanistan, with their class foundation being the theocratic landlord class, controlling Afghanistan’s central government, and are the actual rulers of Afghanistan. Elites include local tribal elders, senior officials, and military commanders, with their class basis being local big landowners and comprador and warlord forces dependent on the Taliban theocratic group, who are loyal dogs of the Taliban theocratic group. The middle class consists of Afghans with certain social status but no political power, also oppressed by the Taliban theocratic group, with their class basis being the national bourgeoisie, some upper urban petty bourgeoisie, and democratic intellectuals. The lower class comprises workers, peasants, and other laboring masses, occupying the bottom of Afghan society, subjected to the heaviest exploitation and oppression, with their class basis being the working class and peasantry.
The oppression of women under the new code is also shocking. Article 32 stipulates that a husband will only be sentenced to a few days’ imprisonment if he “beats his wife with a stick resulting in ‘wounds or bodily bruises’ and the wife can successfully prove this in court.” Even reaching this point is very difficult, let alone the fact that the new code imposes no restrictions on other forms of domestic violence. Moreover, Article 34 absurdly states that if a wife repeatedly visits her relatives’ home and refuses to return after her husband’s request, he can sue her and her relatives, who will face three months’ imprisonment. Additionally, in the clauses that recognize master-slave relationships, the husband is also granted “discretionary” authority to punish his wife, which means that patriarchy and parental slavery are legally supported by the Taliban regime in Afghanistan.
The new code also establishes the religious authority and nearly sole legitimate status of the Taliban theocratic group. It stipulates that only the Hanafi school followed by the Taliban theocratic group is considered “true Muslims,” while other Muslim schools are labeled “heretics.” Article 26 arbitrarily prohibits Hanafi followers from abandoning their faith, with violators facing two years’ imprisonment. Women who declare apostasy from Islam are to be sentenced to lifelong imprisonment and subjected to whipping every three days until they re-accept Islam! Article 17 states that “mocking” and “ridiculing” Islamic teachings will be considered crimes, punishable by two years’ imprisonment. Even more brutal, Article 14 states that with the permission of the “Imam,” any Muslim can kill those “defending false beliefs” or inciting others to believe such beliefs “in the name of public interest” without any legal punishment.
