I worked at a certain factory for 19 days some time ago. There were three of my coworkers on the same production line who arrived at the factory around the same time as me. They are dispatched workers, while I am a regular employee. When I left on the 6th, the factory did not pay my wages and owed me my severance pay. Today, on the payday, I received over 2,600 yuan in salary. Including the medical insurance paid by the factory earlier, the total is 3,000 yuan, but my coworkers, after deducting insurance, management fees, and various other charges, only received 1,600 yuan. How infuriating is that! The phenomenon of unequal pay for equal work in capitalist society has reached an outrageous level!

Suppose dispatched workers eat for a minimum of 25 yuan a day, then in a week, they spend 750 yuan! They are also owed a so-called “difference compensation” of 600 yuan by the intermediary, which is not paid! In a month, they can’t even save 1,000 yuan! How can they survive! How can they live!

Based on this, I am posting here in hopes that everyone can actively offer advice and strategies to help us claim the rightful wages! I will keep track of our wage claim progress here and hope everyone can lend a hand!

This is the payslip of one of my coworkers:
• Paid based on hours worked, with a total of 109.4 hours, an hourly rate of 18 yuan/hour, and a basic hourly wage of ¥1969.2.
• After deducting costs such as medical examination fees, accommodation fees, and meal expenses, the subtotal of the wages is ¥1825.39.
• After further deductions for commercial insurance, service fees, handling fees, and other items, the pre-tax salary is ¥1625.39, with personal income tax of ¥0.
• The final payable and actual paid wages are both ¥1615.39.
The agreed rate was 20/h, but here it turned into 18!

Good news, one of us has already received the deducted fees! (Management fee, property fee). Now there are three requirements: first, settle the salary immediately after resignation. Second, come back to sign the contract and handle various fees. Third, it must be calculated based on the minimum wage. We’ve already taken the first step!

Today, there has been significant progress. Truly inspiring!
After establishing the group, we had a discussion. Since a few people still don’t know each other very well (even though we’re on the same line), we gradually started to connect. We clarified our goals:
1. Settle the salary immediately after resignation. 2. Return to sign the contract and handle all kinds of fees. 3. The wages must be calculated at the minimum wage (our salary is much lower than the local minimum wage!).
After clarifying the goals, a worker threatened the intermediary, saying that if they didn’t refund all the fees paid when signing the contract, he would report them. They compromised, so we took the first step towards victory!
Then I contacted them and drew the conclusion:
A needs to achieve goals 1 and 3
B needs to achieve goals 1, 2, and 3
C needs to achieve goals 1 and 2
After clarifying the goals, the most difficult to achieve is goal 3. Currently, I have no immediate solution, so I suggested they register with 12333 as a backup in case of emergencies. Do any comrades have any ideas?
However, the common issue is goal 1. My current approach is to put pressure on the workers and have them fight against the intermediary!

My coworkers have gained my trust; they are not only willing to show me their contracts and pay slips, but also feel increasingly less distant from me. It truly makes me feel very close.

You may need to print out all the salary slips, because the dog police don’t care how much wages are owed by the agency, they only look at whether the social impact is enough to be considered ‘bad’ and choose to suppress it, gather a few people, then use a phone camera to record and take photos, find the factory in the workshop and the dog supervisor, HR and others to form a group, surround them when forming the group, then Qian Ren comes out to argue with the capitalists @QianRen0, then a worker stands in a row with you, another worker holds a video recorder. It’s best if the video can capture the supervisor’s angry face, provoke conflicts among the workers to make them fight, force the capitalists to call the police to resolve the issue, then check whether the tax agency or the intermediary company has evaded taxes. With pictures of wage slips not paying five insurances and one fund, call the factory to report it to the tax bureau (be sure to call, filling out information on WeChat and submitting won’t be processed). This is based on personal experience.

Another point is not to reveal to Jing Gou how many people you have organized in the WeChat group with colleagues, hide the group and some information, and also don’t tell Jing Gou that you organized four people. Mention these to Zhongxiu to get people involved.
If you don’t trust the empty promissory notes issued by Jing Gou (such as withdrawing from the scene), negotiate openly and avoid private negotiations. During the debate, try to influence the surrounding workers more.
Ask the other party’s agent to promise on the spot to transfer the wages to you. When Jing Gou comes to ‘maintain stability’, use Zhongxiu’s legal methods to stop him, referring to Article 41 of the Chinese Police Law, Supervision Law, etc.
Require Jing Gou to be fully exposed on the workers’ recordings throughout the process (when Jing Gou arrives, ask workers to hide their phones, only leaving the camera exposed). Otherwise, do not split the four people up, as it is easier for Jing Gou to launch a surprise attack.
